URGENT – Crucial October 14th County Evergreen Vote

Mayor and County Commisioners to vote on Evergreen – Tuesday, October 14th


The current Evergreen development plan on Allen Street is at a critical final approval stage.  Next week, Orange County will hold the final hearing vote to approve Evergreen’s 17 1/2-acre home sites and find consistency with the Comprehensive Plan. This is our last chance to speak up to oppose this current plan. Please attend the hearing or contact our commissioners by email or phone and voice your disapproval.

OUR TOP THREE REASONS WHY TANGERINE SHOULD BE OPPOSED TO THE CURRENT EVERGREEN PLAN:

#ONE: 1/2-acre home sites here are not compatible with the Orange County Comprehensive Plan. Since 1991, Rural Settlements such as Tangerine are required to preserve existing development patterns. All of the established home sites around Allen Street and Evergreen are one acre or more.

Here are Orange County’s express Comprehensive Plan terms:  FLUG6.2.5: “The permitted densities and intensities of land use within the Rural Settlements shall maintain their rural character. Factors to be considered shall include lot size, open space and views, tree canopy, building location and orientation, and compatibility with existing land uses.”

Other Tangerine developers have followed these terms for the last 30 years. In fact, we have compiled a subdivision list that includes 529 one-acre-plus recently-built Tangerine homesites. We are providing it to our Mayor and Commissioners as evidence to the character of our Rural Settlement.

Therefore, we believe further homesite development in Tangerine should be at one acre or more except where older platted lots-of-record allowed smaller homesites near the center of town.

#TWO: Approving Evergreen’s new 1/2-acre homesites goes counter to the original 2005 County Board “Planned Development” PD Zoning decision that expressly required one-acre-plus lots and other provisions. The new Evergreen developer just recently purchased the property in 2022 and knew or should have known Orange County’s Planned Development (PD) Zoning for this property. The 2005 PD agreement “for all successors” not only requires one-acre homesites and development of special open space provisions created by the Wekiva River Protection Act, but also other specific provisions such as protecting trees. To this:

#THREE: The new plan improperly adds an unnecessary internal street that clears more than two acres of mature trees. Instead, we believe new development around Allen Street can be served by the existing roads at its southern and western boundary lines. Removing this proposed street can be used to assist in creating one-acre lots with mature trees. The developer should comply with the 2005 PD and change its proposed plan.

What you can do: Attend the October 14th hearing or send individual emails stating that you oppose the new Evergreen plan – including the concern that Orange County’s approval will set a precedent for new development on Tangerine’s several other large tracts of undeveloped land.
